    Seems to me it should be obvious that the term sexual harassment should not apply until the secondary sexual characteristics begin to appear, such as pubic/underarm hair, etc.

    I remember having crushes in grade school — I shudder to think what damage being suspended for a kiss and being accused of sexual harassment would have done to my development at that time.

    I suspect that this is the real issue. Not a single kiss. Likely, the kid is out-of-control, perhaps harassing other students.

    In any regard, I’ve had to deal with issues issues, twice this year, with this same age.

    My approach is to first ask if the other student wanted to be kissed.

    If yes, I would treat is as an appropriate time-and-place issue. i.e. “Nothing wrong with kissing but school is not the right place for it.”

    If the kisses are not wanted — I treat is as an aggression issue. i.e. “You shouldn’t kiss people who don’t want to be kissed.”

    In Kindergarten, it’s mostly an aggression issue which is not a small thing, if it persists. In my cases, this year, it was a isolated incident and no big deal. Let it pass.

    But if the child in his article is being aggressive towards other students and won’t stop, it certainly deserves action.

    I am not a huge fan of suspension. Far better is school-based intervention while the child’s education continues. But that requires funding and the conservatives are hell-bent on de-funding schools.
