Just a minor quibble. Torture is the use of physical or emotional coercion to extract evidence or a confession for a crime, and is a separate thing from whatever punishment is later given. So no, the protection against cruel and unusual punishment in the Constitution would not apply to torture.
Speaking of which, a great read on the history of the use of torture in western societies is “Torture and the Law of Proof” by John Langbein.
