A 21-year-old Harris County woman filed a $200,000 lawsuit against American Airlines alleging employees on a flight to Los Angeles from Dallas/Fort Worth Airport failed to protect her while she slept from another passenger who masturbated to her and ejaculated in her hair, according to a lawsuit she filed last week in Tarrant County.

Destined for a Spring Break visit with family and friends March 19, the woman flew from Houston to DFW Airport and had settled into her seat for the last leg of flight 2074 to Los Angeles about 11 p.m., the suit states. The woman slept most of the flight, but awoke about 20 minutes before landing when the pilot announced the plane was on decent into Los Angeles. When the woman opened her eyes, she saw that an unknown man had moved into the seat next to her and was staring at her as he masturbated, the suit states.

The woman turned toward the window in embarrassment and in an act of nervousness began to run her fingers through her hair where she noticed “a substantial amount of an extremely sticky substance in her hair,” the suit states. The woman began to cry and tried to get the attention of a flight attendant, but was unsuccessful, the suit states. Finally a passenger in the row in front of the woman comforted her and verified the semen in her hair, the suit states.

    Considering I’ve witnessed a couple being forcibly removed by police from a plane after they repeatedly complained because we were being held against our will on the runway for countless hours , how is this not something that at the very least would have been reported to police and have the guy greeted by law enforcement upon exiting the plane? This was clearly a case of sexual assault.

    Airlines have no accountability these days. There is so much government regulation and lobbying on their behalf that paying passengers are treated as if we were stow-aways and should be grateful we got to get on the plane at all.

    The duty of the airline is to transport people from A to B. If you decide to sleep, it’s your choice… and it’s the responsibility of the airline to babysit you during your nap. This and other ridiculous lawsuits are just more signs of the general direction that the US is heading.

    It would depend on her reaction to what happened at the time. If she turned around a quietly wept the rest of the flight, how would the flight attendants know what is going on.

    But if she simply said that this forking bastard jerked off on me while I slept, the other passengers and crew would have had to react at the time.

    This sounds like a frivolous lawsuit to me. And I fly about 90 trips a year on various airlines.

    #9, don’t be a moron, no one is defending this guy. This is a matter of law independent from the airline. It’s not their responsibility to babysit their customers.

    That said I’m surprised that he was not arrested and charged with a number of sexually-related crimes. I would think someone would have noticed.

    She’s still a sleazebag for going after money instead of criminal charges.

    #3–Jägermeister==you have it quite right. Airlines, like buses and cruise ships and trains, are “common carriers” and have a hightened duty of care for the safety of their passengers. This duty goes to the obligation of getting the passenger from point A to B just as you say. Typically, this does NOT include protecting passengers from the criminal activity of others==beyond reponding as a reasonable person would with the knowledge and resources available.

    I think the only thing stopping apprehension of this pervert was the victim stayed quiet and the plane landed too soon? Otherwise, I think the duty of the airline would have been limited to making a call on the PA for any volunteer passengers to put some hurt on the pervert until he could be arrested on landing.

    Case dismissed–no duty.

    #3 You are correct in being concerned about where the US is heading. Instead of arguing about lawsuits and their validity how about some common sense and decency for the people around you?

    The flight attendants may or may not have had a legal obligation to do something but if they noticed and didn’t do anything then they should be fired or worse.

    I hate frivolous lawsuits as much as anyone and don’t think she should be suing the airline unless one of the attendants actually saw something. It’s possible they never noticed which is understandable.

    While I don’t see anything in this story that would convince me that the airline was liable in this case I think I’ll withhold passing judgment on the validity of the lawsuit on the wild assumption that there might possibly be more to the story than what is revealed in a couple of paragraphs from a news blurb.

    Just in the interest of being “Fair and Balanced” here’s a good site for the other side of the “frivolous lawsuit” issue. Not that you’ll ever hear to much about it in the Corporate Media.

    I agree with “jags” on one thing though. America is heading in a bad direction.

    Our founding fathers would be spinning in their graves if the saw how quick we’ve become at giving up the rights they risked everything to attain for us.

    There’s plenty of protections against the real frivolous lawsuit if the people involved just do their jobs.

    And rest assured for every actual frivolous lawsuit that results in damages there is at least one legitimate lawsuit that gets squashed.

    The difference is that the legitimate loser can’t afford a PR firm to transform their story into a cultural myth.

    The Stella Awards are phony, over hyped, pieces of shit. Their excuse for naming the awards goes to a tragic circumstance that they are still in denial about. If you have a case or two to present then please do. The Stella Awards though are promoted by a group that wants to deny Americans from justice and compensation for being hurt.

    Any time someone files a lawsuit, they need to present evidence that the event occurred, they were damaged, and the defendant was the cause. The key word there is evidence. If they fail to convince the Judge that they have a case then the case will almost always be dismissed out of hand. Some of the suits that go to trial sound silly sure. That is until they are viewed in total perspective instead of just one side. The Stella Awards present only that one side.

    In this case, and I am only going on the article posted, the passenger has a genuine case. The passengers are restricted in what they are allowed to do on an airplane. This leaves the crew with a responsibility to protect the passengers to some degree. In this case, the woman was sexually assaulted. So while you might think the passenger doesn’t have a case, just answer the question of “what would you have done if some asshole jerked off on you”?

    In an emergency the airline personnel should have been available. That the woman tried to get their attention and couldn’t should be enough to legally demonstrate the airline’s failure to provide their duty of care.

    By the number of people suggesting this is frivolous, a rational person can equate how many use sperm as a hair treatment.

    Too late. Because the airline has a duty of care to its passengers they already have some liability. The airline is not responsible if they didn’t know they had a sex pervert on board. They might very well be responsible if they did not have a response system in place. If a person requires aid, they need some way of addressing the problem. Ignoring that possibility is not a defense. If the airline had too few attendants to meet the needs of the passengers, then they took a chance and lost.

    I won’t. Conscientious airlines already respond well to their implied and explicit duty of care. It is almost always cheaper to use preventative measures in the first place than it is to pay a large sum later. And remember, not all publicity is good.

    Identify one fact from the story that put the airline “ON NOTICE” there was a problem? None is there.

    As stated==if you want to make the airlines strictly liable for anything that happens on board an aircraft==fine and dandy but stop the moral outrage directed at them==save it for the perp.
