Are prisoners also allowed the option of turning off the camera before they kick a cop’s butt?
They can keep a straight face while saying, “she fell?” Unbelievable.
and the cop was not charged with assault and battery/torture “because”:
if there was a camera in plain view for the cop to turn off, there was a camera hidden that the cop didn’t know about. I’ll wait till that one comes out before i pass judgement. but I have to admit, he’s screwed
This story is 2 years old. By the way, the officer, Wiley Willis, was eventually reinstated and the city paid the woman $400,000.

So it is standard procedure to turn the camera off after she has refused the test… Alright, fair enough.
Is it also standard procedure to turn it back on a few minutes later?
1) Never talk to the police.
2) Never trust a cop.
3) Shut up and ask for a lawyer.

I don’t know about all this. It is suspect that the camera “happened to be off” when the injuries occurred, but this woman was clearly out of control prior to the camera being turned off. Demanding a phone call (which is NOT your right, btw, contrary to what the tv says), refusing to take lawful orders from a police officer, refusing to submit to a substance test (implied consent, anyone?). I’m just not buying the “Innocent Victim” card on this one.
Old story. I love the fact that they said she tried to leave the room and there is a pristine pool of blood smack dab in the middle of the room 10 feet away from the door.
#7 is right, when you are at the station, unless you are there for a tour, don’t say a word unless it’s to ask for your lawyer.
I guess in LA when you refuse the breathalizer they take a blood sample instead…
So if she sustained the injuries (esp the black eyes) when she fell, the police station should be sued for having tremendously uneven and bumpy floors, right.
There’s no way that happened because of a fall, unless it was a ‘police assisted’ fall.
The Supreme Court ruling, which lead to the “Miranda” warning states:
“The person in custody must, prior to interrogation, be clearly informed that he or she has the right to remain silent, and that anything the person says will be used against that person in court; the person must be clearly informed that he or she has the right to consult with an attorney and to have that attorney present during questioning, and that, if he or she is indigent, an attorney will be provided at no cost to represent her or him.”
Which means that you don’t have to answer any questions, and you have the right to an attorney.
But you don’t have the right to a phone call (although some states do include this, and allow a phone but only after the booking procedure is completed).
I nominate her for a Darwin Award.

Look, if I yell and scream at a cop, they don’t get to kick my ass. They get to ignore me, and that’s about it.
Cops are supposed to be able to keep their cool under stress. If you can’t handle some lady yelling at you, you shouldn’t get to be a cop.

#11 if the drunk chick tried to force her way out of the room the cop would have been obligated to perform a takedown. if he had done it from behind her she would have ended up about where the blood trail starts.
#13 have you ever had your nose broken? when i had mine smashed both my eyes were black for a good 2 weeks afterwards. all of her injuries could very easily have resulted from a single takedown, which the police officer was well within his rights to perform. bruises on the arms could be from when the camera was on and he was dragging her back to the chair. all the facial injuries are consistent with her falling/being thrown flat on her face.

Really, what rights was he within to ‘defend’ himself from a handcuffed woman? Sure, she was annoying, but that is NO excuse for what you claim occurred. The cop is a bully and a thug to beat up on a woman because she had a big mouth.
He should have followed procedures and his training, but its on the record that he did neither. If he didn’t even follow procedures he’d have been heavily trained to do, then why the hell do you believe HIS version of what happened. Its already a matter of public record that he fucked up, and yet you’re still defending him. What a moran!

This is old, but it an illustrates a common misconception that gets people in trouble with police time and time again. The police are not your friends, the police are state employees empowered by the courts to enforce the state’s interest. They can and do lie, cheat, beat, threaten with force to make their subjects comply with the state’s interest. It is to their benefit to use as much of their power as needed to reach the state’s goals as possible. The use of force reenforces the need for police power.
I do not agree with what seems to be near limitless power the police seem to have, but because of the nature of our judicial system, there seems to be very little citizens can do to check the power. When you are in the company of a police officer, remember he/she benefits directly from exercising their court sanctioned power on you, if you operate under this assumption – you are being as cautious as you can, and ensuring the best possible outcome for your misfortune.
I don’t think he beat her with his hands but would not rule out a head butt. Cops beating someone is usually limited to young blacks or perhaps gays with a lisp, not pretty girls.
My guess is she did in fact fall and busted her face because her hands are tied.
