I just have to correct the idiots around here.
There is no law, including California, that prohibits third parties from breaking up a fight or stopping an assault.
Most States have “Good Samaritan” laws that protect anyone who aids a person in distress. Even in States that don’t, most courts will protect them except in the most extreme cases.
This has nothing to do with tort. Simple tort law states that you may not gain from your own misadventure. If you are injured during the commission of a crime that is YOUR problem.
But the right wing nuts spreading their lies is the typical fear tactics they know and love so well. To the hell with facts, scare everyone.
They were hired to be professional witnesses. They should have been issued camcorders.
The least these guys should have had is some body armor and mace/pepper spray.
As the saying goes, you want it done right, do it yourself.

About 9 years ago, a family left for vacation.
A burglar entered the house and took items, he found the door to the garage, and entered. The door closed. HE could not find an exit. He drank pop and dog food for 7 days.(LOL)
tHE OWNERS CAME BACK AND FOUND HIM IN THE GARAGE, WHILE PARKING. Called the cops.
He was arrested, THEN he filed a complaint of being held without recourse/kidnapping. HE WON, $15,000. BECAUSE THE IDIOT couldnt figure out HOW to get out of a garage.

#34, thats only true in very certain cases. Breaking up a fight could be argued not to fall under that law, since the argument could be made that the victim initiated the attack, and while a beating is severe, most of the time its not life threatening. Even if you won in the end the lawyer bills could destroy you financially. Why take the risk?
As far as the security guards. They were under direct orders not to get involved, only report. If they did, then the good Samaritan laws that you quoted would not apply to them. They would definitely get sued, or rather the company would.

The “observers” should have “observed” between the attacker and the victim. Attacker strikes an observer, observer has 100% right to self defense and, RIGHT to KILL the attacker if need be, its called Justifiable Homocide. Tell the lawyers to choke on that…and video to back you up..threaten to counter-sue IF any attacker family has a problem with their chilin’ getting justifiably iced.

They are probably all ghetto kids who met on some occasion. Most likely, the kid who got beaten up and her friend learned a valuable lesson: study hard, get a decent career, then grow old and raise your kids in a decent neighborhood. The attacking kids probably went away thinking they are tough and superior and will never make any effort to become better people. Most likely, they will waste away their youth increasing their rap sheets, using drugs, playing basketball at the community court, listening to rap, then die young in jail, or in some stupid gang spat, drug-related squabble or running away from the police.
It’s Darwinism in the urban scape. Just let nature go on with its course.
The thing is that the security people can’t interfere it is one of the rules. And the mom did try to sue but it is just that there was no permanent damage down to the girl so she can’t really sue them. But the people who mugged and hurt her are going or are in jail becuz of what happened.

Being Sued is NO excuse. I would rather go before a judge or jury for doing what is morally and ethically right then for watching a CHILD get beaten and robbed by a group of adults. I can’t believe how many of you commenting can rationalize allowing one human being to hurt another this way. And the funniest part is, those of you saying that the Security guards did the right thing also talk about what a menial and underpaid position they hold. Doesn’t that alone make it easily replacable. If these security guards are getting paid minimum wage then why not do the right thing and apply at McDonalds? Absolutely disgusting.
