An exclusive American clothing shop banned a disabled sales assistant from working on the shop floor because her prosthetic arm did not fit with the store’s “look policy”, a tribunal heard today.

Abercrombie & Fitch demonstrated a “blatant display of eugenics” when they “hid” 22-year-old Riam Dean in the stockroom instead of letting her serve customers as per her job description, the central London employment tribunal was told.

Dean, a law student from Greenford, Middlesex, is suing the firm for disability discrimination after she was left “personally diminished [and] humiliated” while working in the American firm’s flagship London store last summer. “I had been bullied out of my job,” she said. “It was the lowest point I had ever been in my life…”

Dean, who was born without her left forearm, claims that when she told A&F about her disability after getting the job the firm agreed she could wear a white cardigan to cover the link between her prosthesis and her upper arm. But shortly after this, she was told she could not work on the shop floor unless she took off the cardigan as she was breaking the firm’s “look policy”. Her job was supposed to entail four roles – two on the shop floor and two in the stockroom.

A&F management “used the ‘look policy’ and the wearing of the cardigan as an excuse to hide me away in the stockroom”, Dean said today in her evidence. “I knew then that I was being treated different and unfairly because of my disability,” she said, before breaking down in tears.

    Come on they wouldn’t let her in the sales floor. They didn’t stop her from breeding. But it has been a while since I was in an A&F. So I could be wrong.

    On one hand (har), her boss was a retard. On the other hand she sounds awfully whiny. I don’t know how it is in the UK, but this brings up one of the problems with the Americans with Disabilities Act here in the US.

    Assuming what she’s saying is true then her boss should be fired, but instead of contacting the company’s upper management it seems she jumped straight into lawsuit territory. Here in the US the ADA allows disabled people to sue over pretty much anything, encouraging lawsuits.

    The result is that there has actually been a sharp drop in the employment of disabled people since the ADA was passed, defeating one of the main purposes of the ADA.

    Similarly, Hooters would not hire a guy nor a waitress with one breast.

    She should simply acknowledge that she is not a good fit for obvious reasons.

    The UK seems to have problems dealing with one armed women.     I can only hope all good people would conform to the value that people should be JUDGED on their abilities, not on their looks when it comes to basic relationships/necessities of life. After working hours, who I date is completely up to my own bias and prejudice.

    Depends on the “context”. If a business has determined that it sells more if the employees look a certain way, then it should be up to them. Unless, the gov is going to subsidize them. It is a private, not public concern.

But dont hire someone, fully knowing their disabilities, and then not be happy with it.

    That’s what civil/employment contracts are for. If they violated it then she should sue.

    The ADA was meant to help people get into the workforce and be good, contributing citizens. I’m in a wheelchair and it took me 2 years to find a job. Not because I’m under qualified. Not because I had requests the employer couldn’t meet. All because 90% of employee areas and interviewing areas are not accessible. They get around this by exploiting a portion in the building code that allows for 900 square feet of non public space to not have to be accessible. So they make little pockets of 900 square feet areas that are for employee work areas. Finally when I found an amazing employer, and architectural firm in Buffalo, NY and we started working for some of the american chains…we were disgusted at what they were doing. When we brought it to their attention, they replied with “we do this to potentially cut down on the added cost of hiring those with disabilities. Most times they require help to fulfill their tasks and therefore cost our company more than their wage and insurance.” My boss instantly ripped up the contracts and told them to leave out office. I had been an employee with them for 3 years at this point and had never had to ask for extra help. If you think its a coincidence that she was forced to work in a back room, I’d wager it wasn’t.

    That is discrimination. You cannot tell she has a fake arm unless you look closely, but that is beside the point.

    I once worked at a department store with someone who was missing his right arm all the way up to his shoulder. He could do everything the same as everyone else in the store even though he was right handed. He learned to start doing everything with his left hand.

    The ADA has been abused in a lot of cases, but in this case, they are just discriminating against her. She probably doesn’t need accommodation since she can do the same job with one hand.

    When I got home from the hospital I couldn’t get into my own house!

    I sat in the drive way while someone built a ramp for me to get in…

    Needless to say, everywhere I go I notice now if it’s ‘accessible..

    It is just good business to meet ADA requirements…

    Even better yet, try getting around with your eyes closed.

    I’m in a chair 29 years from a motorcycle accident. the insane opportunities i’ve had (and lawyers egging me on) to sue over discrimination issues is mind-boggling.

    seems people think it’s a handidude’s sworn duty to sue over petty discrimination. did anyone get physically hurt beyond repair? no? -then stfu and get a life.

    what’s the point? i’d rather spend my time and energy finding people who are fun to work with than potentially wreck a person or company’s livelihood over their personal hangups or worse, hurt feelings.

    i’d love to tar & feather the guy who thought to push diversity, PC Correctness conformity and all the rest of that ideology into the mainstream / political agenda. it completely ruins every country it infects.
