Dean, a law student from Greenford, Middlesex, is suing the firm for disability discrimination after she was left “personally diminished [and] humiliated” while working in the American firm’s flagship London store last summer. “I had been bullied out of my job,” she said. “It was the lowest point I had ever been in my life…”
Dean, who was born without her left forearm, claims that when she told A&F about her disability after getting the job the firm agreed she could wear a white cardigan to cover the link between her prosthesis and her upper arm. But shortly after this, she was told she could not work on the shop floor unless she took off the cardigan as she was breaking the firm’s “look policy”. Her job was supposed to entail four roles – two on the shop floor and two in the stockroom.
A&F management “used the ‘look policy’ and the wearing of the cardigan as an excuse to hide me away in the stockroom”, Dean said today in her evidence. “I knew then that I was being treated different and unfairly because of my disability,” she said, before breaking down in tears.
“Conformity” – is one of the most contemptible words in the English language.
“Conformity” – is one of the most contemptible words in the English language.
So is authority.
Terrible policy and probably a violation of the ADA but they should loose the case because of incredibly bad use of language.
“Abercrombie & Fitch demonstrated a “blatant display of eugenics””
eugenics- The study of hereditary improvement of the human race by controlled selective breeding.
Come on they wouldn’t let her in the sales floor. They didn’t stop her from breeding. But it has been a while since I was in an A&F. So I could be wrong.
Yeah, don’t let the hot girl work at A&F because she’s just a tad under perfect. I hope they throw the book at the company.
Diversity is the most contemptible word.
This is not a lot different than Hooters only hiring hot chicks. It’s what helps you make more money and that is reason to be in business.
Oh honey, please sue. Sue those tasteless bastards out of existence. I’m tired of the blaring music you can hear three stores away and the stench of $15 perfume. I swear the only reason kids go in there to shop is because everyone else hates them.
@2
Yeah I’d breed with her! she’s cute! 🙂
hehe
On one hand (har), her boss was a retard. On the other hand she sounds awfully whiny. I don’t know how it is in the UK, but this brings up one of the problems with the Americans with Disabilities Act here in the US.
Assuming what she’s saying is true then her boss should be fired, but instead of contacting the company’s upper management it seems she jumped straight into lawsuit territory. Here in the US the ADA allows disabled people to sue over pretty much anything, encouraging lawsuits.
The result is that there has actually been a sharp drop in the employment of disabled people since the ADA was passed, defeating one of the main purposes of the ADA.
A&F should hire who they want to preserve their look policy. That is what they are known for.
Similarly, Hooters would not hire a guy nor a waitress with one breast.
She should simply acknowledge that she is not a good fit for obvious reasons.
What’s wrong with her left arm?
@3:
A&F isn’t that interested in having hot girls work in their stores, disabled or not. Doesn’t fit their demographic.
Hee hee, #7 said “on the other hand”…

The UK seems to have problems dealing with one armed women. Apparently the CBBC (children’s bbc) has a one armed girl as a presenter on some shows and some parents wanted her off the air because she was “scaring” kids. http://dailymail.co.uk/news/article-1152466/One-armed-presenter-scaring-children-parents-tell-BBC.html
Here’s a video about it which unfortunately autoplays http://news.bbc.co.uk/2/hi/uk_news/7908686.stm
If a gov is going to control internally how a business is run they have to be ready to take responsibility for said business…
““Conformity” – is one of the most contemptible words in the English language.” //// Conformity is neutral and becomes good or bad only in context. I think other words that “force” conformity to a single standard are far worse. Patriotism, God, a call to 911.
I can only hope all good people would conform to the value that people should be JUDGED on their abilities, not on their looks when it comes to basic relationships/necessities of life. After working hours, who I date is completely up to my own bias and prejudice.
# 14 bobbo, “I can only hope all good people would conform to the value that people should be JUDGED on their abilities, not on their looks when it comes to basic relationships/necessities of life. ”
Depends on the “context”. If a business has determined that it sells more if the employees look a certain way, then it should be up to them. Unless, the gov is going to subsidize them. It is a private, not public concern.
8# Yea agreed, but the point is, they hired her knowing she had the fake arm, then had issues with it after they hired her. If they want a certain look presented to the public by their employees, then great, I have no problem with that. But dont hire someone, fully knowing their disabilities, and then not be happy with it.
On the other hand she is sure starting off on the right foot as far as being an aspiring lawyer. LOL I would dare to bet that Litigation might be her specialty whens shes done with school.
If a business has determined that it sells more if the employees look a certain way
Does that include skin color as well?
# 17 jccalhoun said, “Does that include skin color as well?”
It includes whatever works. Unless, you are willing to pay up to the company concerned. Are you?
# 16 yea said, “8# Yea agreed, but the point is, they hired her knowing she had the fake arm, then had issues with it after they hired her.”
That’s what civil/employment contracts are for. If they violated it then she should sue.
wow,
she’s hot!
and I’m not being sarcastic.
#17 It should if it effects sales. And Blacks should be glad it does. I know of several places that wouldn’t hire blacks if it didn’t mean that blacks would stop being customers.
#21 Right, and I wouldn’t patronize a business that wouldn’t hire someone based on skin colour.
It’s time for a revolution. All us posters should meet at Johns house for a strategy session and lunch. At least show up at the Deli for a free sub and beer. I await his answer.
A&F is wrong on this one.
and I think some ‘damages’ are appropriate.
I mean is anyone ‘perfect looking’ enough to even shop there?
I’m not.
The ADA was meant to help people get into the workforce and be good, contributing citizens. I’m in a wheelchair and it took me 2 years to find a job. Not because I’m under qualified. Not because I had requests the employer couldn’t meet. All because 90% of employee areas and interviewing areas are not accessible. They get around this by exploiting a portion in the building code that allows for 900 square feet of non public space to not have to be accessible. So they make little pockets of 900 square feet areas that are for employee work areas. Finally when I found an amazing employer, and architectural firm in Buffalo, NY and we started working for some of the american chains…we were disgusted at what they were doing. When we brought it to their attention, they replied with “we do this to potentially cut down on the added cost of hiring those with disabilities. Most times they require help to fulfill their tasks and therefore cost our company more than their wage and insurance.” My boss instantly ripped up the contracts and told them to leave out office. I had been an employee with them for 3 years at this point and had never had to ask for extra help. If you think its a coincidence that she was forced to work in a back room, I’d wager it wasn’t.
That is discrimination. You cannot tell she has a fake arm unless you look closely, but that is beside the point.
I once worked at a department store with someone who was missing his right arm all the way up to his shoulder. He could do everything the same as everyone else in the store even though he was right handed. He learned to start doing everything with his left hand.
The ADA has been abused in a lot of cases, but in this case, they are just discriminating against her. She probably doesn’t need accommodation since she can do the same job with one hand.
#25, I had a motorcycle accident… and had to use a wheelchair for quite a while… Needless to say everyone should try it for a few days!!!
When I got home from the hospital I couldn’t get into my own house!
I sat in the drive way while someone built a ramp for me to get in…
Needless to say, everywhere I go I notice now if it’s ‘accessible..
It is just good business to meet ADA requirements…
Even better yet, try getting around with your eyes closed.
WOW! I can’t even imagine what that is like forever.
I find the opening shot:
“..An exclusive American clothing shop…”
-more interesting than the handidudett’s story.
why the American tie-in…to…Eugenics?
—
-anyway.. the girl should smack the guy who made her prosthetic in the head with it. it looks like crap.
—-
-as for you beading heart idiots promoting lawsuits..
why waste your time suing them? she a friggin IDIOT! she just made getting a job for herself (and others like her) 1000x harder.
everybody will be walking on eggshells around her in the workplace. -this is no different than playing the race card in the workplace.
-way to go Einstein
if your that thinned skinned over petty crap like this, just sic a local paper on them. -turn it into a PR nightmare for them AND LEAVE IT AT THAT.
if they’re bloody idiots, and you have the time to waste, name and shame and walk away.. you’ll get plenty job offers from do-gooders or people who know having the likes of her on staff is an asset more often than not in today’s manic, PC correct society.
I’m in a chair 29 years from a motorcycle accident. the insane opportunities i’ve had (and lawyers egging me on) to sue over discrimination issues is mind-boggling.
seems people think it’s a handidude’s sworn duty to sue over petty discrimination. did anyone get physically hurt beyond repair? no? -then stfu and get a life.
what’s the point? i’d rather spend my time and energy finding people who are fun to work with than potentially wreck a person or company’s livelihood over their personal hangups or worse, hurt feelings.
i’d love to tar & feather the guy who thought to push diversity, PC Correctness conformity and all the rest of that ideology into the mainstream / political agenda. it completely ruins every country it infects.
bottom line, she’s an idiot for suing.
#7 is Spot On..with an assist from #4 😮
/me gets off the soapbox
-s
I hear there is an Old Navy that would LOVE to have her and the publicity.
