I watched the whole video, and some of the related material available out there.
The guy is intentionally antagonizing and provoking this fight.
I don’t have any idea if the local law allows a search, or what the “boundaries” are for such a checkpoint stop. Based on the text read by the driver during the incident, which they evidently showed him, it seems like they didn’t have cause under the grounds they’re charged with.
The senior officer who comes out and tried to reason with him made a strong case that his behavior was suspicious, but if their jurisdiction ends with immigration offenses, then they had no grounds up until the alleged “canine” incident. I have no trouble at all believing they fabricated the “dog hit” because this guy pissed them off. However, once he started behaving in a suspicious behavior, he probably gave them enough legal grounds to pull him over for discussion. I doubt very much he has the legal right to argue from within that car — I think he has the legal right to exit the vehicle and then have any evidence found thrown out if it was the result of an illegal search.
Further, he refused an entirely lawful order to present valid ID while operating a motor vehicle. (Smart move from whichever cop thought to ask him about that.)
That said, regardless of his behavior, and their legal grounds or lack thereof, it looks like there is an excessive force claim here.
I should clarify something, because I just finished watching the very last part of the longer video – I had paused it to write something here…. the really long one where he gets into the protracted argument ends with him being ALLOWED to leave.
So he’s got at least two trips through and footage from two incidents…. interesting.
The incident in question was on another trip through the same checkpoint, apparently, which almost certainly makes it a planned retaliation.
Which is much worse, and supports his excessive force claims all the more, though I still suspect a judge would find him guilty of something along the lines of obstruction of justice, or of failure to present a valid driver’s license when requested while operating a motor vehicle, etc.
Cops probably lost that case when the pulled out the tasers, though.
Wow, it sure must be fun to carry a badge these days. You can freely tase people, freely kick people in the head, freely stop and search people without cause. What a wonderful country we live in!
Let’s not forget that these “Border Patrol Checkpoints” aren’t even located at the border! You can literally be 100 miles from the border and be stopped at these “Border Patrol Checkpoints”, have your car window smashed in, tased, and have your face cut up…simply because you didn’t want to play “Simon Says”. These “Border Patrol Agents” were willing to do all of this, but were completely unwilling to bring the sniffer dog out for one more sniff of the car? At that point, I realized this was more about authority wanting to be obeyed for the sake of preserving ego and power, rather than any actual patrolling of our boarders!
Seems to me this kinda crap has always been going on. The difference is before they stuck to drunks and racial minorities, now anybody (from this video I’d say anybody at all) can get tased and while they’re spasaming get the crap knocked out of them. Brings to mind a song by an old rap group named NWA – ‘F_ck the Police’.
I’ve said it before and I’ll say it again, it’s not too late to emmigrate.

It was certainly inevitable that this guy was going to end up getting beaten. But you folks who think he had it coming need to think long and hard down that road. As long as the “authorities” think it’s ok to ignore his constitutional rights then NO ONE is safe. Can’t happen to me… bullcrap. Working to undermine the constitution is TREASON and you become guilty by association when you condone this crap. Get out of my country.
Just don’t get caught using your cell phone in California on the highways.
#62 Alfred1, your quotation of scripture from the Bible where Jesus tells people to dutifully pay their taxes unto Caesar because his likeness and inscription is on the money doesn’t really seem applicable to this situation. I really think you could have done better. Perhaps you should pray for more inspiration next time.
It’s the kind of situation that makes you want the judge at the eventual hearing to ask the arresting officer to stand up, close his eyes and wait, while the judge steps down from the bench and cold-cocks him.
If he was actually at the border, bad on the Pastor. If he wasn’t, he did nothing wrong.
