Orchard Park police are investigating a particularly gruesome killing, the beheading of a woman, after her husband — an influential member of the local Muslim community — reported her death to police Thursday. Police identified the victim as Aasiya Z. Hassan, 37. Detectives have charged her husband, Muzzammil Hassan, 44, with second-degree murder.
“He came to the police station at 6:20 p.m. [Thursday] and told us that she was dead,” Orchard Park Police Chief Andrew Benz said late this morning. Muzzammil Hassan told police that his wife was at his business, Bridges TV, on Thorn Avenue in the village. Officers went to that location and discovered her body. Muzzammil Hassan is the founder and chief executive officer of Bridges TV, which he launched in 2004, amid hopes that it would help portray Muslims in a more positive light.
The killing apparently occurred some time late Thursday afternoon. Detectives still are looking for the murder weapon.
“Obviously, this is the worst form of domestic violence possible,” Erie County District Attorney Frank A. Sedita III said today.
Authorities say Aasiya Hassan recently had filed for divorce from her husband. “She had an order of protection that had him out of the home as of Friday the 6th [of February],” Benz said. Muzzammil Hassan was arraigned before Village Justice Deborah Chimes and sent to the Erie County Holding Center.
So second degree murder? Really, how does that work?

If she went to him, pre-meditation isn’t obvious, I think more information is needed.

Course, “legally” premeditation only takes the time it took to reach for the knife. Thats why I say there was likely a ton of it.

Premeditation is if he went to her house planning on killing her OR was planning on some other crime (robbery) and ended up killing her. There has to be a plan to do something before hand for First Degree.
Killing someone on the spur of the moment is almost always second degree. There does have to be the intent though.
If it was an accident or you didn’t mean to kill the person, then it usually becomes manslaughter, even if you were stupid.
Of course, Cow-Patty is going to tell you “not in CA”.

#11–Fusion==we almost agree. Premeditation can happen very swiftly, like even the simple act of grabbing a knife. It can also take much longer like an intricate plan which often includes other charges like “laying in wait.”
Most dictionaries fail to catch the term as it is applied in court.
First degree is supposed to be “more heinous, more shocking, more disruptive to society” than second degree. Some statutes/courts deny first degree to any domestic circumstance because of the personal/non-general risk to the public type issues involved.
I think First Degree should apply to any murder committed in violantion of a court order==which may not have applied here if she went to his office?

#15 It is VERY rare that (x) applies in a murder. It is pretty much impossible in NY to 1st degree for a “simple murder” with malice aforethought. This statute is a point of controversy in the State.

Neat. How, I ask, does a Muslim “behead” his wife, exactly? Bread knife? Jig saw? Scimitar? Call OJ? Chain saw? Crosscut saw? Really, it seems like a very messy way to avoid alimony. He did do that, at least. So really, is she dead BEFORE the head is severed? Or during? Or after? Icky, but these are fundamental questions. Too bad she was not a cop or a judge.
