As people keep watching this economic crises unfold we keep hearing that Bush is going to declare martial law. But Bush has no control over the Democratic Congress and it’s the Democrats who control this “bail out” not the Republicans. The Democrats also control the war in Iraq. So this Congressman says the Republicans have been shut out of the bail out legislation and nobody has any idea as to what is in the bail out bill. There are hints that much of it has little to do with bailing out anything but is a money grab. And what is all this about Pelosi declaring martial law?

    Really, paddy-o, I’ll give you some leeway on politics, but even Eldrige Cleaver recognized when “the man” shows up at your door, you’re fucked. Ask the people at Waco and Ruby Riddge and in New Orleans during Katrina what good their weapons made. I am a gun ownership advocate myself, but frankly more for sport and/or day 5 of the blackout than to physically resist the government.

    Only the Commander in Chief (Bush) can nationalize the guard and call them up.

    Governors may call up the Guard to deal with any emergency.

    The President does not have the authority to unilaterally declare martial law. That is a function of the Congress. Under Art. 1, Sec. 9 Habeas Corpus may only be suspended by Congress.

    See ex parte Milligan (71 US 2 [1866]) . There the Supreme court held that

    “Martial law … destroys every guarantee of the Constitution.” The Court reminded the reader that such actions were taken by the King of Great Britain, which caused, in part, the Revolution. “Civil liberty and this kind of martial law cannot endure together; the antagonism is irreconcilable; and, in the conflict, one or the other must perish.”

    This court also went on to write that Martial Law may only operate when the civil courts are closed. The mere presence of Federal troops does not warrant Martial Law.

    Does anyone on here even understand our government from a grade school perspective?

    Uuhh, not quite. Executive orders may not usurp Constitutional or Legislated law. Generally, they have only a regulatory effect where Congress has not already legislated the regulations or their form.
