Amid growing criticism from 3G iPhone customers, a class action complaint was filed against Apple Tuesday in U.S. District Court in Alabama.
The lawsuit alleges that despite aggressive marketing that the 3G iPhone is “twice as fast for half the price,” the much-hyped smartphone is actually much slower than advertised and prone to dropping calls.
“Apple sold these devices on the promise that they were twice as fast as the pre-existing phones and that they would function suitably, or properly, on the 3G network. But, thus far, Apple and the phone have failed to deliver on this promise,” Jonathan Kudulis, an attorney with Birmingham, Ala.-based Trimmier Law Firm, told ABCNEWS.com. Trimmier is the firm representing the Ala.-based plaintiff, Jessica Alena Smith.
But Kudulis says, because the complaint was only filed yesterday, Apple has not yet been officially served with the lawsuit.
Apple does not comment on pending litigation, a company spokeswoman said.

Apple has never provided the most for the least.
A big part of Apple’s appeal at least to me is that normally it has it’s quality control well in hand. The buyer could count on having a positive experience.
I’m not sure if this has broken down or if AT & T is to blame or if somebody has inflated expectations but this is an issue Apple needs to carefully address.
I have no personal experience with this device because the phone bill stops me cold.

Oh, iPhone…
Not to specifically stick up for Apple iPhone.
But in my experience the speed of cell based broadband is a similar experience to WIFI at home.
The further away you get from the distribution point the slower it gets. I have never been impressed with this type of broadband no matter what you use. But this is where Apple over hypes its products and unfortunately in the iPhone case.
They way over promised 3G speed.
the fundamental problem is that Apple doesn’t really know how to “do” a phone the same way they can do a laptop or desktop or a PMP.
they screw up both of the rollouts – the first was less of a train wreck because you could at least be at home for the hours it took to activate – they partner with AT&T, which has very sketchy performance, when you finally can buy apps for it, they are buggy and crash the thing, and so on.
if it wasn’t for the cool interface and the Apple logo, the problems would have killed it. vaya con Newton.
but Apple can learn. I figure the WiMax phone in 2010 or so will be a much smoother experience.

I wonder if this could lead to a reverse of a trend. Instead of trying to put more, and more features into a device, it moves to putting fewer, but all extremely reliable and work exactly as advertised, features into a device.

I guess Microsoft should be sued for Vista then. Hmmm, on second thought, extend that sentiment to about 75% of the products in existence.
You kids do know that Apple is about to rev most of their product line, right? These stories will be forgotten by the end of next month.
Why Sue Apple? Wouldn’t you sue AT&T? I mean if I have a Nokia 3G phone and it was dropping calls I wouldn’t sue nokia. Cash grab by some country bumpkins, that’s all
I have an iPhone 3g and have not had any problems with it. My 3g connection speed is about 450 kbs. I don’t know how that compare to other phones but it beat my razor all to hell. Wifi in many places and some cool apps. I’m keeping mine.
