MOUNT JULIET, Tenn. – A Midstate man said a police officer nearly choked him to death during a traffic stop. The incident was caught on tape. The Tennessee Bureau of Investigation is investigating how Mount Juliet Cpl. Bill Cosby interacted with James Anders, Jr. Cosby stopped the 26-year-old Wilson County man in April. Cosby suspected Anders hid marijuana in his mouth. The officer used a vascular restraint technique to keep Anders from swallowing. On the video recorded inside Cosby’s patrol car, Cosby said he smelled marijuana and handcuffed Anders and his passenger. The video also showed the officer putting his hands around Anders’ neck. He applied pressure and told Anders to stick out his tongue. This happened for nearly two minutes before Anders lost consciousness.

Photographs released by Anders’ attorney showed injuries he sustained when he fell to the pavement. Cosby didn’t find any marijuana in Ander’s mouth. Anders passed a drug test the next day. A small bag of pot was found in his car and Anders was arrested for simple possession and resisting arrest. After the district attorney saw the video, the charges were dropped. Anders is expected to file a lawsuit in federal court later this month.

Cosby is still on the job.

    This is one of those cases where a simple rule applies or not: Should cops be allowed to choke someone in order to prevent the swallowing of evidence?

    I see the reasons for either answer.

    On balance, I say “No.” The evidence is not lost–just put where the sun don’t shine. So, arrest, book, and take for medical exam. Everyone’s legitimate interests are protected.

    This is abuse of power, plain and simple. The quantity of dope that he could have hidden in his mouth would be a misdemeanor offense at most, certainly not an ‘intent to distribute’ felony level offense.
    It is time to start taking our streets back from the cops. “To protect and to serve”… yeah right… more like “To abuse and intimidate”.
    The cops that did this (both of them) should be sued until they are homeless. Cops need to fear ‘abuse of power’ as much as we now fear the cops.

    Cops are there to “Protect and to Serve”. It is time that we remind them of that forcefully. Shit like this is completely and utterly unacceptable and unjustifiable, and cops need to fear taking unjustifiable actions of this type.

    funny how we only get to see the the part of the officer choking the suspect. I assume that there are minutes of the tape before the choking started where you see the the cops pull this kid over, handcuff him, and question him or are they trying to hide the fact that maybe this kid was trying to hide someting. this is little more then a defense lawyers attempt to get sympathy for this idiot kid.

    I hate it when liberal hippies and defense lawyers try to sway the public with these cheap shots!

    They didn’t find anything on him (exception: in the car). Injuries were sustained as well as physical assault regardless.

    In the end, we do find out that the suspect is indeed just another druggie. I say give the cops a medal.

    What happened before or after is irrelevant. What is clearly shown is an assault by two police on a restrained person. End of story.

    That is a criminal offense. Even if the guy had busted a cops jaw, the police are only allowed to use enough force to restrain the person, not beat him.

    Don’t need sound. The video tells a very compelling story by itself. Even if the force does nothing, the town will be on the hook for a lot of money. If that cop ever arrests someone again and the person screams assault or planted evidence then look for the case to be tossed. From now on, that cop is toast.

    There is no law that says the guy must open his mouth or submit to every whim a cop tells him to do. There is a law about choking a person until they fall unconscious. It’s called assault.

    Besides what some people like to believe, cops aren’t running around trying to kill innocent people.

    So, if the police try to kill you that means you must be guilty? We could save a ton a money by doing away with our courts. Of course only those who hate America would want to do away with the Constitution. Tell us Jerk, why do you hate America?

    In order to enforce the laws, our officers are allowed to break the laws? If I did that to someone else while restraining him before I am hired and trained as an officer (hell, probably after too), I’d be in jail myself.

    Point being is that this guy’s rights were violated. There are other methods to obtain the evidence if it was even there and needed in the first place.

    I don’t like people smoking marijuana, using heroin, or anything like that. (Hell, I can barely stand tobacco use.) However, I don’t go around cutting off oxygen to people who do it.

    What if the officer actually killed the man? What if the officer permanently injured the man? How in the hell is he allowed to have that judgment in that course of action when (according to what I read) the suspect was not combative enough to cause harm?

    Sorry for the double-post.

    Supposedly the judge that heard the case was so pissed about the entire incident that this officer’s cases (current, pending, and any future cases) are dismissed if brought to this judge’s court.

    Supposedly the police chief that was sworn in had the officer reprimanded but that is all I could gather from the news report.

    It’s interesting that we have such a litany of police abuse, with shocking stories of over-agressive cops misusing their authority being disclosed every week. Yet why aren’t the cops taking more steps to police themselves? Why no policy statements from police leadership on their new initiatives for proper treatment of the citizenry?

    The question “who will watch the watchers?” is as old as society itself. Most of those who serve the public do so well and with honor. However, the attitude that punishing bad cops is against the brotherhood as well as the related attitude that cops are above the law and somehow different people than the average citizen must go.

    Had the kid been properly trained he would have gone after the offending officer first by stomping his knee cap down off and down his shin and into the cops instep. He would then head butt the other officer, spin and grab his gun and pop both of them. Then by sitting on the ground can pull his legs through and get his cuffed hands in front of him, pop one more into the cop that was choking him and leave the scene. At least that is how it would have been done in my movie. Last scene would have the kid driving away in the cop car with his cuffed hands at the 11 and 1 position on the wheel and smoking the pot that was planted on him.

    An alternate ending would have James Hill anally raping the cops after stumbling on the scene and finding the bodies still warm.

    Remember an applicant has to meet a certain level of stupidity before they are allowed to be a police officer. Police departments routinely turn down intelligent applicants in favor of more stupid ones.
