A state appellate court has rejected a lawsuit against makers of a video game by family members of three people killed by a teenager in 2004 on a southern New Mexico ranch owned by newsman Sam Donaldson.

The state Court of Appeals today dismissed an appeal in the wrongful death lawsuit.

The lawsuit alleged that the video game “Grand Theft Auto: Vice City” contributed to the killings because Cody Posey played the game “obsessively” and it trained him to act out the violence when he shot and killed his father, stepmother and stepsister in July 2004.

Posey was 14 at the time of the killings. His father worked as Donaldson’s ranch foreman.

He was convicted in 2006 of first-degree murder in the death of his stepsister, second-degree murder in the death of his stepmother and voluntary manslaughter in the death of his father.

For the three murders, Cody Posey will be in custody of the state juvenile department until he’s 21 years old.

Oh, the lawsuit? The rest of the family wanted $600 million.

    Glad that court has some common sense. Research by Dr. Cheryl K. Olson and Dr. Lawrence Kutner has been in the news lately. It has shed some more light on violence in video games. Google their book “Grand Theft Childhood”.

    Why was he allowed to play GTA when he was 14 in the first place?!
    Certain games are simply not intended for a 14-year-old: GTA Vice City was rated 18+ in the UK!

    That’s correct in a limited sense, people without guns kill less people. Unless they have nuclear bombs, then you can kill without facing your opponent but it is a bit messy.

    #2 – Whatever… I let my kid play any game he liked… the result? He got good enough to beat me… and as an adult, he, like most gamers, is a good upstanding member of the community.

    Games are good.

    Especially GTA.

    Oh give me a break! My kids play video games, including GTA. It’s a game…it’s a totally stupid game. Graphics are pretty, and it’s cartoony. It’s no more likely to cause any kids to kill than the Wiley E. Coyote caused kids to try and catch Roadrunners.
    Give me a BREAK. This is such total and utter nonsense.
    The kid is a f*uck up, parents probably were losers. Losers make more losers. Psychopaths breed. I’m so sick of the finger pointing and the bullsh*t about “oh, it MADE ME”. Excuses, excuses, excuses.
    As for guns don’t kill….well, they DO make it mighty easy to do it. By that same thinking: Knives don’t kill… bricks don’t kill, baseball bats don’t kill, rope doesn’t kill…but it takes a heck of a lot more ENERGY and intent to do it than a little bullet speeding out of the barrel of a gun.
