City: Mom’s claim stinks
A New York woman who took her family to visit the Maritime Aquarium has filed a $100 claim against the city, saying her child’s shoes, along with the entire outing, were ruined when her 1-year-old stepped in dog feces early last month outside the Maritime Garage.

Norwalk officials will deny the claim, city attorney M. Jeffry Spahr said. “The official response is her claim is denied and poop happens,” he said.

“After parking, we exited the garage and my 1-year-old son was walking around the structure outside the door of the garage and stepped in a large pile of fecal matter,” DeBrocky wrote. “I quickly picked him up and brought him to the aquarium and did my best to clean him up.”

“After a long car ride, it was not practical for me to immediately turn around and go back home with a small child. We had to pay for admission to the aquarium and my son had no shoes and it made the entire experience awful.”

Spahr said he has seen some frivolous claims, but the feces claim reeks.

“Some wacky stuff comes across. I don’t know if people are more litigious. My opinion is two things are at play. No. 1, people are resistant to taking responsibility for their own actions and No. 2, they feel there always has to be somebody to blame,” he said.

Other claims without merit, Spahr said, include a boater who blamed the city after his boat, docked at the city marina, filled up with water in a heavy rainstorm and sank.

They’ll probably have to call in CSI to DNA test the poop, find the responsible dog and make him or her testify. And in a related story, Brits use their surveillance system society to prosecute dog poop violators rather than terrorism. Feel safe yet?

    First CSI will have to establish it was a dog, right? I mean, this is an Aquarium we’re talking about here…

    Being both a parent and living in a dog-overpopulated city (Bay Area), I think she has a valid point. While the majority of dog owners are responsible, the irresponsible ones can really fsck up a parent’s day, and there’s very little incentive for them to (quite literally) clean up their act – they know that their chances of being caught (let alone punished) are miniscule.

    So an alternative is to give the city / county an incentive to police dog owners (or rather a disincentive for not policing dog owners) – perhaps then they’ll look at other measures (such as reducing the number of dog licenses they dole out willy nilly).

    Now before all you dog lovers get up in arms and claim I’m some kind of animal hater, I grew up with working dogs on a farm and there’s nothing crueler than leaving an active animal such as a dog locked up for 12 hours a day in a dingy inner-city apartment – taking them for a one hour run at the end of the day doesn’t cut it either – dogs are active animals and simply need more room to move than a city allows.

    If a city is going to provide a public place for kids to walk, owned by the city, the city has an obligation to keep the area clean enough for kids to walk, and not step in crap. She will get her $100.

    Frankly, I think I should be able to read blog’s with out having to read about dog shit. I am suing John C. for $100 for ruining my evening. I was planning to go out for a nice meal, but all this talk of dog shit has put me off it.
