OK, so the real story isn’t quite so exciting as the headline, but it’s a slow news day so far and you know you thought there are lawyers who might just do what the headline says.
Suspect, 91, has been dead a month
Attorneys in the case of a 91-year-old Palisade man accused of sexual assault spent Wednesday morning in court trying to determine whether the aging man was fit to stand trial.
It turns out he wasn’t. He died nearly a month ago and has been cremated, according to a relative who contacted The Daily Sentinel.

“That’s a relief for public safety,” Mesa County District Attorney Pete Hautzinger said when told Ridenour had died.Attorneys handling a hearing Wednesday, however, apparently were unaware Ridenour was dead.
Who remembers Ken Lay who “Died” and was cremated without an autopsy or funeral ??? Wonder if he wound up in Costa Rica ???

Dead people testify, get sued, and sue themselves all the time. Getting prosecuted is a new wrinkle though.
If I hadn’t clicked on the link, I’d swear that would have been straight out of The Onion.
The when alive the man in question was healthy enough to sexually assault a nurse at his nursing home…hence bringing on the charges. He just died to avoid getting full medical in prison.
Assuming the man had lived, is it possible to be found “Not Guilty by reason of Alzheimer’s”?
