A court in Italy has determined that a user can request a refund for unwanted Microsoft software that’s sold bundled with a new PC. The EULA for Microsoft software indicates that a PC manufacturer has to reimburse the user the value of Windows XP and Microsoft Works.

HP must reimburse Italian PC buyer the amount paid for Microsoft software – heise.de: An Italian PC buyer has the right to claim from the manufacturer of his or her device the amount paid for the Microsoft software that was shipped together with the PC he or she bought but that he or she does not intend to use, a court in Florence has found.
According to a statement by the plaintiff in the case, it transpires from Microsoft’s end user license agreement (EULA) that anyone who rejects it should, to be reimbursed, turn to the PC manufacturer

The judgment, comes on the heels of a ruling in France that became known recently. The French court had ruled that Acer was obliged to refund the plaintiff not only the 30 euros it had volunteered to pay but the full price of the software that had been delivered together with the notebook the plaintiff had purchased but which he did not intend to use.

    The manufacturer in this case can then claim that all the software bundled with the PC came FREE! You get NOTHING!

    I think they mean the price the manufacturer paid to the software company (this case Microsoft) for the software.

    I highly doubt HP or Acer pays nothing to Microsoft.

    I have two hp desktops and I formated over xp with ext3 file system and linux. I need a refund from the microsoft tax. The hp paki support line sucks pakis are not smart!

    Yes because I’m sure none of the Italians are using XP. They’re all running Linux. HP should say ok and MS should deactivate windows for all HP Italian computers.
