Film star Jessica Alba demanded that Playboy magazine pull its March issue, saying on Thursday that its editors made her an unwitting cover girl and misled readers into thinking they could see her nude inside.
Lawyers for Alba sent Playboy a letter threatening to sue if it did not remove the issue — which features a publicity photo of the bikini-clad actress on the front — from the stands and pay for damages to her reputation and career.
“Playboy has violated my personal rights and blatantly misled the public, who might think I had given them permission to put me on their cover when I didn’t,” Alba, 24, said in a statement.
No comment.
Considering there’s a photo of her on the ‘net that’s a lot more revealing than the one used for the Playboy cover, she should consider herself lucky.
She’s apparently forgotten that Playboy did the same thing with Paris Hilton last year, and Paris Hilton said exactly the same things about suing them, etc. And nothing became of it. Why? Because the photo is the property of a distributor, not the actress. This picture is question is a publicity still from “Into The Blue”. Playboy bought the picture, much like other magazines buy publicity shots of actors, so they have every right to use it. If they had said on the cover “Inside–Jessica Alba NUDE!”, then yes, she has the right to sue. But they don’t say that anywhere. This is a magazine that used the picture as they are allowed to, but it just so happens the magazine also predominantly shows pictures of naked women.

Funny how people want to be out the in the field of Publicity, and not be looked at.
It’s funny to me that in todays world of objectifing our children, that somehow when they call foul, because they might be considered, slu**y. Maybe you shouldn’t be in the career you choose. I am objectifiy Jessica right now in my mind, I didn’t pay for anything, and she has no rights to my thougths.

I’m too lazy to google the Suzanne Somers case, where she posed nude for a photographer – who years later sold them to Playboy. Seems like it might be relevant, though. I don’t think she won anything from Playboy, but Ace Hardware settled after dropping her contract as their “ad babe”.
Heiress Hilton is just a mediaa wh#re, so I don’t think her case is relevant to anything. 🙂
I can’t see Playboy pulling the issue from the stands, unless Alba’s lawyers can prove a violation of the model release – or some text on the cover implying nudes of her were inside the magazine.
Alba signed a model release. Playboy never claimed she was naked inside. Not on the cover, not in the magazine. Hopefully a smart judge will explain the benefit of free publicity to her and tell her to shut the hell up.
This entire discussion still begs the obvious, unasked question:

All the cover states is “Shes the sex star of the year” I think the readers can figure out that shes not nude in the magazine. Like being on the cover of playboy will her reputation and career. DUH!

This lawsuit smells like a publicity gimmick. She can be outraged AND in playboy at the same time. She keeps her public morals but gets more publicity as a sex symbol. Playboy sells more issues. It’s a win win win.
